Can Consumable Goods be Leased?


  • The essence of a lease of things is the enjoyment or use of the property with the obligation on the part of the lessee to return the same upon the expiration of the lease.

  • A thing is consumable is a movable which cannot be used in a manner appropriate to its nature without itself being consumed.

  • Hence, things which by their nature cannot be used without being consumed, cannot be the subject matter of lease.

LEASE OF PERSONAL PROPERTY WITH OPTION TO BUY


  • Sellers desirous of making conditional sales of their goods but do not wish openly to make a bargain in that form, for one reason or another, have frequently resorted to the device of making contracts in the form of leases either with option to the buyer to purchase.

  • Rules of contract of sale of personal property the price of which is payable in installments are equally applicable to the so-called leases of personal property.

  • The remedies available for the seller are alternative and not cumulative and therefore, the exercise of one bars the exercise of the others.

SUBLEASE BY LESSEE


  • When in the contract of lease of things there is no express prohibition, the lessee may sublet the thing leased.

  • The contract of lease must expressly stipulate the prohibition on subletting.

  • In a sublease, the lessee becomes in turn a lessor to a sublessee.
