REVISED GUIDELINES ON THE ENGAGEMENT OF CHILDREN 15 TO BELOW 18 YEARS OF AGE IN PUBLIC ENTERTAINMENT DURING COMMUNITY QUARANTINE

  • A child 15 to below 18 years of age may be allowed to participate on-cam in studio or location shoots for public entertainment or information during community quarantine.

  • A child 15 to below 18 years of age who is allowed to participate in an on-cam cam in studio or location shoots for public entertainment or information must follow the minimum public health standards as prescribed by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases, Department of Health, Department of Labor and Employment, Department of Trade and Industry and other government agencies.

  • The child has the right to refuse work.

Under Republic Act No. 9231 or Special Protection of Children Against Child Abuse, Exploitation and Discrimination Act, children below fifteen (15) years of age shall not be employed. This is however subject to exception:

  1. When a child works directly under the sole responsibility of his/her parents or legal guardian and where only members of his/her family are employed.
  2. Where a child’s employment or participation in public entertainment or information through cinema, theater, radio, television or other forms of media is essential.

Due to the Covid-19 Pandemic, the Department of Labor and Employment (DOLE) has issued a new advisory for the engagement of children 15 to below 18 years old in public entertainment.

Labor Advisory 24 Series of 2020 issued on 08 July 2020 provides that:

A child 15 to below 18 years of age may be engaged in pubic entertainment or information during community quarantine provided that his/her participation shall be done in his or her home under the supervision of adult family members.

Representative of the employer or production staff may be allowed to go to the child’s home, when necessary, to assist the child in performing the assigned task.  In such cases, the employer shall inform the DOLE Regional Office having jurisdiction over the workplace of the child of its intention to engage a child 15 to below 18 years of age and submit a plan on measures that it will undertake to ensure compliance to health protocols.

However, on September 11, 2020, DOLE issued Labor Advisory No. 24-A revising Labor Advisory 24, to wit:

A child 15 to below 18 years of age may be allowed to participate on-cam in studio or location shoots for public entertainment or information during community quarantine provided that the minimum public health standards as prescribed by the Inter-Agency Task Force for the Management of Emerging Infectious Diseases, Department of Health, Department of Labor and Employment, Department of Trade and Industry and other government agencies are the strictly implemented and observed.

The child has the right to refuse work as provided for by the laws in the Philippines.
