Every November 1, it is a Filipino tradition to go to cemeteries and honor our departed loved ones on All Saints’ Day. It is a time of reflection, remembrance, and family gathering. But aside from its spiritual and cultural meaning, the day also has implications for workers’ pay. Since it is declared a special non-working holiday, employees who report for duty are entitled to receive premium pay, while those who take the day off are not bound to work and are typically subject to the “no work, no pay” principle, unless a company policy or collective bargaining agreement provides otherwise. This holiday, therefore, not only reminds Filipinos of their faith and traditions but also highlights the country’s labor rights and compensation rules during special occasions.
On October 22, 2025, the Department of Labor and Employment issued Labor Advisory No. 13, Series of 2025 in relation to the payment of Wages for the Special (Non-Working) Days on November 1, 2025.
Under the said Labor Advisory, pursuant to Proclamation No. 727, Series of 2024, the following pay rules shall apply:
- If the employee does not work, the “no work, no pay” principle shall apply unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day;
- For work done during the special day, the employer shall pay the employee an additional 30% of the basic wage on the first eight hours of work;
- For work done in excess of eight hours, the employer shall pay the employee an additional 30% of the hourly rate on said day;
- For work done during the special day that also falls on the employee’s rest day, the employer shall pay the employee an additional 50% of the basic wage on the first eight hours of work; and
- For work done in excess of eight hours during the special day that also falls on the employee’s rest day, the employer shall pay the employee an additional 30% of the hourly rate on said day.
